Good news? New consumer rights show

Eventually it looks like there's hope on the horizon for all of us who've been driven out of our minds when having to deal with big companies and their *bleep!*.

SABC2's announced that they're launching a new consumer rights show called Speak Out at the beginning of April that's going to give consumers the opportunity of screaming at companies and torturing them on-air for their crimes against humanity.

I just made that up - not the show but the wishful thinking torture bit. Bwahahahaha!

This from the press release:

The ordinary consumer often feels abused by retailers and service providers and isn’t sure how to address the situation or get a satisfying solution.

Hosted by TV presenter Dosto Noge, Speak Out aims to be the champion and the wake up call. The show sets out to challenge retailers and service providers on behalf of the person on the street and to investigate civic issues that currently affect us all, for example load shedding.

With strong investigative research behind them the team will expose bad service and show consumers how to handle such situations themselves.

One of the features in the show is “Hero and Zero of the Week”. In this section the show will look at service providers who have gone out of their way to provide exceptional service, the complaints that have been resolved in a way that is above and beyond the expectation of the consumer and those retailers or service providers who have failed to correct their mistake in any way at all.

This is a running total as it were and companies may find themselves as Zero of the Week for a long time if they are not careful.

I like that bit in particular - "if they're not careful." I'm beyond fed up with how uncaring and disrespectful so many of the corporates are towards us.

What I also like about the sound of the show is that as far as I can see there's no product sponsoring it so it can be as objective and fierce as it needs to be to really implement change.

I've been concerned that we'd never see this sort of thing because of how corporately controlled many shows are but it looks like it's going to avoid it.

I've never forgotten Isabel Jones and how much she disappointed me - one moment she was the champion of the people and on our side fighting for justice and value for our money in Fair Deal and the next she was a Verimark advertorial.

There hasn't been a show since her that's tackled these sorts of issues and it's long overdue. Let's hope it brings us some customer satisssfaction.

PPS: You know what I really want to know - how much a Pick 'n Pay cashier makes a month with a rundown of what they can realistically buy from the store on it.

I once chatted to a policeman shortly after he'd been called out for a theft at Pick 'n Pay - a staffer stole a chocolate and his words were: "No one steals a chocolate unless they're hungry."

PPPS: I got carried away and forgot - Speak Out starts on Thursday, 3 April at 18h00.

PPPPS: (ridiculous I know) I've heard  - and fully believe it's true - that not speaking out about stuff - 'spesh if you feel you're being bullied and abused - is verry bad for your health.

PS: A word of advice - don't ever be tempted to buy a Verimark Orbitrek - you will never use it. Tash, I nearly bought this piece of isht but I was amazed at the amount of 'second hands' being sold on gumtree for way less than a thousand rand...so I got suspicious and never went ahead.

PS: Don't buy Glomail salon nail manicure tool....piece of trash
PS: Don't buy the Dry Buddy (Homemark/tevo)...it takes three days to dry a couple of shirts.

Molilo gal, you can go out there and buy it, maybe you will be lucky to get a product that delivers on 'its' promises.

I have a steam iron, purchased from either Glomail or Verimark...I can't remember...I was also sold by their advert especially were they show us the iron doing its magic on the curtains (already hung)...and geez the amount of steam it was producing..nc nc nc nc...I just had to have it. The end results, well let me just say once you lift it vertically it switches off (how did they get it work on the curtains???)...don't expect t iron jeans, linen clothing and other materials that need an effort.....I would say save your money or go buy yourself a Russell Hobbs iron.

LM it is the same iron I saw on TV the green one. I was so inlove with the steam part of it since it was to assist with the embroided clothing as well. Thank you so much I am not going to waste my money on that iron anymore. Especially since it switches itself off, talk about good advertising.

Apologies! it was a typo from me - it's Dosto Noge.

Check this out - just found out that Isabel Jones died at the beginning of the month after open heart surgery: Consumer journalist Isable Jones Dies.

It's a very interesting story 'cos it confirms something I've  wondered about - they have journo's saying the same as us about her losing credibility with her product advertising and a quote from her from a Carte Blanche interview saying: "As a consumer journalist people would obviously not prefer me to do infomercials, but I really don’t want to be destitute in my old age with a little placard around my neck at a traffic light."

This is the whole problem with speaking out generally - it's almost impossible for someone to survive a lifetime on what she was doing previously.

If Fair Deal had gone on forever she would have had an income but once it finsihed she obviously had to find another source of income for her future and selling must have been the only role anyone was prepared to pay her properly for.

It’s a crime of apply for contract phone?? Few Months ago I did apply for contract phone to one of the cell phone provide; with in that month I submit a cancellation letter of that application form. After that submit that letter know I received legal letter of demand that say I must pay them for the phone which did not even have it even a sim card. Question to your mzansti it’s a crime to apply for contract phone.

I bought cough fron furn city, cost R25,000 they scrathced them when they deliver  I reported to Gavin who was the Manager at Mitchells Plain branch in Cape town. He said i must keep on paying instalment. 3 months later he bought me something to put on cough glue and cloth. the couch became worse scratches opened. When I finish my instalment i formed them , they said theres nothing they can do, I phoned head office report the matter, they said if im interested to the couch I must buy the new one again. so now the problem I dont have R12.000 to cover the couch , i need help its been a long time,i lost hope, but It realy hurts me when I look at my lounge suit.

Can you please help me , last year December we went to Eastern Cape in Queenstown and my Husband was driving his care Volvo XC90 . January 2 days before we can come back the car stopped and he phoned a Towing company in Queenstown and they towed it . Because the motor plan was finished and we didn't have insurance we took to Company called Automatrix in Quuenstown and the owner said he'll fix the car and he made a quatation for R26000 and we came to Pretoria and left the car , End of February my Husband paid the R26000 and till today the car is not fixed and they dont anser the phones when we are calling . My mother in Law saw this program on TV and she suggested that I should ask for help from you . 

Can you please help us beacuse now we cannot get hold of this Guy .

My mother Ms FK Dlamini started a Non-profit organisation called Sikhovha preschool in 2003
The following process was followed in establishing the organisation
1.2.1 She sold her ideas to women within the community
1.2.2 A constitution was drawn up and submitted to the department of Social Development in Pretoria
1.2.3 An NPO certificate to operate the organisation was then obtained
1.2.4 Women who were interested in the idea were appointed as members
1.2.5 She then applied for a site within village from the traditional leaders which was approved.
1.2.6 She paid the rates for the approved site
1.2.7 Whilst she was still trying to ask for funding, she requested accommodation from the nearby school , which was also granted by the school
1.2.8 This NPO has been operating since 2003 without financial assistance from Government
1.2.9 During 2008, financial assistance was received from Government 
Towards the end of 2008, social workers started interfering in the management of the organisation and since then the following happened:

2.1 Unarranged visit to my mother’s house
2.1.1 The Department of Social Development employee by the Name of Nkhensani and Martin has been interfering with other administration of the organisation apart from the financial monitoring of the assistance provided
2.1.2 She visited her house without prior arrangements
2.1.3 She accused her of hiding all documents of the organisation
2.1.4 She demanded to be given the constitution as well as the NPO certificate
2.1.5 She indicated that despite the fact that my mother was a chairperson, she does not have anything to do with the financial management of the organisation
2.1.6 She indicated that if my mother does not resign, the Department will withdraw its financial assistance
2.1.7 She forced my mother to go with her to one of the members house so as to prove that she did not have the financial records


2.2. Meeting conducted in her absence
2.2.1 During November 2008, an employee by the name of Martin conducted a meeting where a new committee was elected without her knowledge
2.2.2 The meeting was called by someone who is not even a member of the pre-school
2.2.3 I requested a meeting with the social workers and in the meeting my mother indicated that she was the founder of the pre-school and they did not have any right to conduct and elect new members without her knowledge.
2.2.4 One of the senior staff by the name of Nomghibelo indicated that conducting a meeting was a mistake and they will arrange another meeting to redress the issue
2.2.5 She also indicated that because my mother insisted that she was a founder, then it means that the pre-school is private and therefore the Department of social development will withdraw the funding
2.2.6 I explained the following to them regarding her understanding of the NPO
2.2.6.1 The organisation has a founder who is normally the chairperson
2.2.6.2 It is an organisation that is not profit driven
2.2.6.3 It is an organisation that is aimed at improving the life of community members through for example, creation of jobs
2.2.6.4 The organisation does not belong to the community but aimed at assisting the community
2.2.6.5 Members of the organisation are not elected and appointed by the community
2.2.6.6 The organisation can source financial assistance from any institution
2.2.6.7 Any member can request a meeting through the secretary and the chairperson must approve such meetings

3. During 2009 the following happened:
3.1 The school asked her to move out its premises due to the fact that one of the people elected by the social workers was a member of the governing body within the school

I took a policy cover for household equipments with First For Women, and in July 2011,whilst at mi sister's funeral my phone's battery was flat and i took out the simcard my younger sister borrowed me her phone and i took mine put it in the side pocket of the laptop bag, we went to fruit and veg to buy vegetables and when we came back i asked some guys at home to unload the vegetables. Later that day when we were going home to sleep mi sister realised that the boot door is not closed she got outside and closed it and we continued with the journey on

saturday we went for burial and when we finished i wanted to charge mi phone and laptop when we got to the car they were not there so we went back to the funeral i asked the guys who were unloading the vegetables if they saw them and they said no, on the 18th July i went to the police station to report them and they said they cannot help me without an ITC number from Vodacom since they is a book which they write the blacklisted report phones in,i waited for a week or so to get and ITC number from Vodacom which when i got it i went to the police station and they gave me an affidavit i faxed it to First For Women and they said they need an affidavit from the officer that the they returned me.i gave them all.

MY NAME IS GERRIE VENTER. I BOUGHT A CAR AT A SECOND HAND DEALER AND I HAVE IT FOR 3 MONTHS NOW BUT IT GIVES PROBLEMS THE WHOLE TIME. I CALLED THE PEOPLE OF XAVIER MOTORS IN BLOEMFONTEIN TO COME AND ASSIST ME THATS WHEN I HEARD THE CAR WASNT EVEN TRU AA AND NOT EVEN ROAD WORTHY. IT WAS ON SUNDAY 8 APRIL 2012. THEY SEND OUT PEOPLE TO PICK UP THE CAR WE WAITED THERE TILL 6 O'CLOCK THAT EVENING AND I CALLED THEM AT 12 O'CLOCK THAT AFTERNOON. I HAD AN ELDERLY LADY WHO IS 85 YEARS OLD IN MY CAR. Please help me in relation to your following paragraph.

For Example if one would want to purchase a new motor vehicle from a dealership, some dealerships would have a 30 day Guarantee ( or testing period) if within the 30 days the buyer is not happy with the motor vehicle, they can take it back to the dealership for their money back, pending that there is no damage done to the vehicle.

I went into a rent to own option due to me begin under debt review (which I have cancelled and started paying my accounts direct)

(Risk Management company name -S.A Drive) I paid R18 000.00 deposit and the monthly instalment is R4200.00 for a Golf 5 2004 comfort line, mileage of 289995 on receipt. (prorate of R1150.00)
Now is 308256
The contract covers for service, tyres, insurance and tracker : the car should be evaluated within 5 days on receipt – which I did on Day 3

The day of receipt the car the following happened:
1. had a broken windscreen and they did fix at 5H45
2. The hooting system was defective
3. Tyres worn out Promised to fix after 2 weeks (16 inch and they only stated that they were will to only pay R2000.00 against R4700.00 and told me that in Johannesburg they will get this set for less.
4. Wiper blade worn out
5. On the 23 September 2011 (date of purchase) while driving to KZN Ladysmith in Warden the car started having problems the (engine sound) car sounded like diesel car while its petrol,
6. On receipt I took the car for assessment to VW Ladysmith and the defects on the car were R25.000.00 which I did inform the company (quotation rejected) without suspension check
(I paid a fee of R467.89 for the report).
7. In less than two weeks of ownership I had a breakdown which I then took the car to Ladysmith Auto Clinic for repairs
8. The maintenance manager promised that the company will fix the car but in parts not all at once.
9. The company approved to Pay R6850.00 to Ladysmith Auto Clinic (phrase one of repairs) while I was not mobile during this period and the workshop refused to release the car without any payment which turned sour when the dealer was contacted.

I eventually had to pay since I took the car to them for the repairs and I was still paying while I was not using the car (proof of email correspondences available on request)
The workshop advised me to have the car sent back, I them phone Mr Harry –Maintenance Manager) who informed me that I should fix the car and they will payment back.

The disc expired in October 2011 since then I was fined 2 times for failing to display a valid disc which in November the disc was sent to me by the accounts lady (christel) by post.

And that is when I started to experience problems poor communication and insults – I continued to pay the monthly instalment as per contract states with the 1 month up front since the instalment was due on the 1st of every month and I get paid on the 15th . The agreement/contract which on review it only covers them ( but I was still protected by the clause which required me to have the assessed within 5 working days which I did. And no consumer protection was available and the contract can only be terminated should I die. (available on request)

I send request to them to try and fix the car which was a big hazard to my safety – as the left front wheel came out while driving to work.
I took the car back to Ladysmith Auto for repairs thru a breakdown from Mooi-river back to Ladysmith.

I contacted a lawyer for advise who is not doing much to assist – but a letter of demand was sent to them – Since February I have not paid the instalment as the company is refusing to pay me back not even for tyres (R22 000.00 – and the board indicated engine faulty)

Mt J.D Van Niekerk (Company Share holder) who was the recipient of the instalments then phoned me threatening me that if I don’t give the car back they will have me arrested so I should just give the car to a breakdown which contacted me and I requested them to come with proof as I have contacted a lawyer regarding my dispute and He then Advise me not to release the car unless they have something in writing . (the Advocate –Mr Richard Linda Qwabe is off sick with cancer and is no longer available.

I have lost ideas to on dealing with the matter and the court could not help since this was a civil matter and not for small claims court, Legal Aid could also not help.

What should I do.

Good day. I am Cynthia. I need advise please. Mobimoola has been deducting from my bank account without me lending money from them. They have been giving me the runaround for the past 3 weeks now and no one can tell me when i will receive my money back. They have promised to call me back or let their supervisors call me back , every day since the 26th of August. They do not have a headoffice number or a direct line, just this tollfree number where you hold on for ages. Eventually they started cutting my calls, I think they can see my number as I have been talking to almost every consultant in that call centre
