Juju is Expelled by the ANC

Here's part of the ANC NDC statement on Juju being expelled.


Comrade Julius Malema 

14. With regard to the charges against comrade Malema, the NDC does not accept that there is a political motive in the charges.

15. The NDC Finding which was confirmed by the NDCA, was that comrade Malema had publicly expressed his personal views in contravention of ANC policy, thereby sowing divisions within the organisation and bringing the organisation into disrepute.

16. Full reasons for the finding against comrade Malema were set out in the Finding and the NDC does not consider it necessary to restate these reasons.

Present disciplinary hearing

66. The Complainant led aggravating evidence against comrade Malema with regard to the current convictions.

67. Whilst comrade Malema testified that he subjected himself to the discipline of the ANC and that he would comply with any sanction imposed by the NDC, the NDC is particularly disturbed by the following evidence given by comrade Malema at the mitigation hearing:-

67.1 In his evidence-in-chief, comrade Malema said that he did not agree with the Findings of the NDCA and repeated it under cross- examination.

67.2 He said that he was not persuaded by the NDCA findings and will continue to challenge the outcome internally because he was unfairly found guilty.

67.3 He said that the disciplinary proceedings will come to an end but the real battle will start after that when the ANC has to persuade the youth.

68. In the NDC’s view, this evidence is indicative of comrade Malema’s unrepentant attitude and non-acceptance of the findings of the disciplinary machinery of the ANC, particularly the NDCA.

69. The NDC accepts that as a tribunal of first instance in this case, comrade Malema has a right not to agree with the Findings of the NDC because the ANC Constitution gives him and the other comrades the right to appeal to the NDCA.

70. However, Comrade Malema’s refusal to accept the Findings of the NDCA, which confirm the findings of the NDC, is clearly untenable.

71. Comrade Malema should have known or have been advised that Rule 25.6 (a2) of the ANC Constitution declares decisions of the NDCA as final, except that the NEC may, in its discretion, review such a decision.

72. When comrade Malema joined the ANC he undertook in his membership oath to respect the ANC Constitution and its structures.

73. As stated above, both the NDC and the NDCA are structures that are created in terms of the ANC Constitution.

74. The NDC is of the view that if comrade Malema is not prepared to accept final decisions of the NDCA, then the likelihood of him respecting the ANC Constitution is remote.

75. This conclusion is reinforced by his utterance that after the conclusion of the disciplinary proceedings, which are conducted in terms of the ANC Constitution, the real battle will start when the ANC will still have to persuade the youth. As the President of an organ of the ANC responsible for mobilizing the youth behind the ANC, this statement, in the view of the NDC, constitutes a threat and is tantamount to holding the ANC to ransom.

76. Moreover, in his application in August 2011 to quash the charges, one of the arguments raised by comrade Malema was that the ANC Constitution was unconstitutional. In its ruling, the NDCA confirmed that he did raise this argument.

77. Comrade Malema is a repeat offender. He has now been found guilty of two serious offences in under two years whilst under suspension after his 2010 Finding; has shown no remorse; is not prepared to be disciplined by the ANC and is not prepared to respect the disciplinary machinery of the organisation.

78. Based on comrade Malema’s own evidence the NDC finds that comrade Malema is, in effect, reneging on his membership oath and is not prepared to respect the ANC Constitution.

79. With regard to comrade Malema’s plea not to have his membership taken away, the NDC believes that any period of suspension imposed as a sanction would not, as the Complainant’s representative submitted, achieve the purpose of rehabilitating the comrade.

80. In the view of the NDC, comrade Malema’s misconduct of bringing the ANC into disrepute and sowing division within its ranks is very serious.

81. The ANC Constitution demands that discipline be enforced without exception. The cumulative effect of comrade Malema’s past and present offences, coupled with his own evidence of lack of remorse and disrespect for the ANC Constitution and its structures, particularly the NDCA, has left no room for the NDC to consider his misconduct as anything but extremely serious.

82. In exercising its duty to balance the interest of the Respondent on the one hand and that of the ANC and its membership as an organization on the other hand, the balance weighs in favour of the ANC to impose the sanctions as stated below.

Hayi shem yazi I am not happy that Juju is expelled by the ANC. I know he had verbal diarrhea but at times Juju said things that needed to be said but many afraid to point out. 

Mna I knew that the ANC was not going to give him a better sentence seeing how Juju was behaving even though he was under suspension. He didn't show an remorse whatsoever he continued being the Julius Malema that many know him to be even though his future with the ANC lied on the ANC NDC. 

Like recently akere he went to the miners strike and encouraged the miners to keep on striking while other ANC people were condemning the strike? And he didn't see any wrongdoing in whatever the ANC suspended him for. 

What I like about Juju though is that he has not given anyone the idea of him going to another party or forming his own party because he has been preaching it that his blood will remain green, gold and black. So the newspapers and political analysts cannot speculate about Juju crossing the floor to another political party or forming his own.


I am worried about his gran shame because now the anti-Juju faction is camping outside her house celebrating Juju's downfall and there are even shootings taking place outside the house. 

But the situation is said to be under control as Sowetan reports. Juju also addressed his supporters who were also outside his gran's house to show support. 

Eyi I can't wait to see how this drama will unfold it seems like it's not over yet.

Eish,i am numb, sad and angry.  I can't believe the ANC yielded to outside influence to have him expelled.  What a harsh sentence tjo!  Today i woke up to the news of his expulsion and i almost shed a tear. You know i cant even continue writing my thoughts as i am in deep pain.  I am wearing all black today, in mourning of his expulsion.

Eish wena Mathaz yazi I am also very said about this. Even though I didnt like the way Juju went on and on about Mbeki by the time he was buddyz with Zuma still I am sad about him being expelled shame. 

ANC really does have double standards. There were alot of things that Juju said about Mbeki before he was fired as the President no one even cared about disciplining Malema but now there are suspensions left, right and center, hayi!

Serias Maddie, u are heartsore?. I have been heartsore many times coz of the insults he hurled at people. The vitrol that he spewd and spread on those who had no anchor has been a painful event to watch. I have been in political pain since he emerged in 2008, and this is a slight relief, although we know its a case of one mafia removing another for their own benefits, this has nothing to do with outside influence nor 'the people'.

Poor Juju...Other than being a total blabber mouth, Juju always said the truth where it was due, all this is to just puke him completely out of the party so that THEIR evil under-carpet activities are never expozed! JZ and his allies think we are stupid, where was the NDC when Juju was busy insulting president Mbeki back then, in public. where was the anc constitution they preach about now. I dont condone what juju is doing and what he did back then, he was used as a pawn, now he doesnt fit in their bigger plan. Trust me, this is just a rehearsal for more drama to unfold.

Im happy today so happy today that Malema is expelled...singing loud. Malema our parents taught as to respect and you didnt. Someone had to stop you. Thanks NDC. Sometimes you spoke sense yes but most of the time you were misleading us as youth. You are now out  and we are waiting for Mr Mathaleto get out too.

PPL sana i dont have any sympathy for this guy, he kicked out Thabo Mbeki, and belittled him in front of the nation, tht was uncalled for, 2ndly he made funny comments or statments to tht lady tht was raped by Jz, which i still didnt hear wht really happen there,, 3, very stupid and disrespective person, he can  say whtever, when he make comments on tv or radio, u as an ANC FOLLOWER OR S.Aficasn must  cross your fingers corse he will say wht comes to his mind, he was thin thin thin, now uomkhaba, udla imali ze ANC, u driver ma range rover, uyadelela, hayi makahambe shame.

i knw his has 99% followers but im not 1 of them, i love my country,

Baby Juju had it coming. But knowing politics, i wouldn't be surprised if JZ is removed from his post come Mangaung time and interim President appointed till the national elections. Then, I wouldn't also be surprised if the new leadership would say Juju was not afforded a "fair trial" or whatever. This is not over shame yazi

Shem the ANC does not know what they are doing.  Malema is such a poweful and influential person at the grass root level, that's where most support is needed.  Clearly the NEC could rule against his favour mara Zuma is not clever, he knows we are a country who like political victims, we are drawn and atrracted to people who are hurt and used.  It is tue there is no aboslute freedom mara to expel him is so uncalled for.  Yes, they might get rid of him but the issues that he raised still remain unchanged.

This guy made me feel uneasy. First time i heard him with my ears on radio my ear hurt. Such rudeness and no respect. I didnt hear any sense that u talking about in his speeches. With politics its not about an individual but an organisatiön, you cant put ur agendas before the policy of the party. I will only cry when the Anc dissolves as a party. Save ur tears

I am so glad this fool has been removed from ANC, he was an embarrassment to the party. He actually thought he is the *bleep!*!! untouchable! I could stand him insulting individuals, but to go out and blatantly disregard the partys regulations and constitution was just playing with fire. He never even attended to any of the relevant youth issues, he just did not know anything about good manners and he could learn nje. So good bye to bad rubbish, no one is above the ANC, not even Zuma.

The sentence was too harsh,some members leave anc for other partys and they come back when the package is not good enough,anc should accept juju back,even a priest cannot have all sweet kids,juju is good and bad at the same time and he is the product of jz when he wanted thabo out,mangaung is going to be a bip circus with the youthleague against the rulling party
