I am looking for a lawyer

I am all for buckling up your child in a car seat cause children need protection and i am all for the government legislating this. What i have a problem with is being forced to wear a seatbelt by getting a fine for not putting it on.

Worse case scenario is that i accumulate all these tickets, don't pay them, get a warrant of arrest issued and most probably end up in jail. Now can you imagine spending time in jail with someone that was convicted of murder or incest or attempted murder? I don't think there are sections in jail where petty criminals are housed and it is because of this possibility that i want to challenge this law.

Whose problem is it if i want to die in the event of an accident? How different is driving without a seatbelt to having sex without a condom, to smoking, to drinking, to getting in a bath filled with boiling water, to popping diet pills without a prescription, to starting an exercise programme without a doctors recommendation? eish man i see people in taxi's and in buses that don't wear seat belts....WTF? People are buying cars that make that irritating sound if they don't put their seatbelts on and i think that's more than enough.

I can get all the speeding laws but i seriously don't think putting on a seatbelt should be enforced by law. As an adult i should be given the freedom to decide for myself whether or not to put a seatbelt on. I know that seatbelts can save lives but i also know that you can be trapped in your car because of it. If this one chance exists, should i be FORCED to take the CHANCE of dying inside my car because of a seatbelt?

I don't think so. If you know of a lawyer that will take on anything, please let me know.

I feel you Tox, I feel you....  I do not liked being strapped in,...  I also have this nitemares of being in accident and have to get it out of the car before it explodes but I can't get out because I am panicking so much that I can get out of the seatbelt trap...


If you know of a lawyer that will take on anything, please let me know. 
I also want that number of that fearless lawyer... constitutional courts, we are on our way!!!

Hmmmm, no Tox as much a it should be your choice to wear a seat belt or not, it would be a selfish choice not to. Yes there's a chance of being trapped but I don't think its as great as dying. Until car manufacturers find ways of making cars safe, seat belts should be a must. Think of all the stars we've lost due to a culture of 'non-seatbelting', and we've all said had they been wearing seat belts, their lives would have been spared. Now be a good citizen and put on your seat belt each time u drive :-)

no no no, sweet ladies - WEAR THE DAMN BELT!!! i've lost people i love in car accidents, and they would've survived if they'd been strapped in....  get over the irritation.

 As a safe driving sign at the botswana border post says (and it cracks me up every time i see it!) PLEASE DRIVE SAFELY - WE LOVE YOU AND NEED YOU....

I am aware that seatbelts can save lives.....and i sometimes put one on. My gripe is with the law that FORCES me to put one on. i cannot be in a jailcell with a hardened criminal all because i didn't put one on!

I also want that number of that fearless lawyer... constitutional courts, we are on our way!!! 

LOL, i am designing placards in my head already WSG!

Hayi man Toxy lovie, please wear that seatbelt, at the end of the day the chances of u dying becoz u haven't worn one will always be higher than the chance of u dying coz u wore one.

Mna I only put it on when someone else is driving, on a freeway. I dont think I need it when driving around town to work or the shops, except on those weekends xa inyanga imbi, you know they're always lurking around looking for amasente.

It's called a SAFETY  belt for that reason and that reason only:SAFETY! BUT if you feel that you want to take the chance of dying because upoqe (popped out) out of your car and I hit you with mine,we wont allow that.i am very glad that there's no lawyer to take that one out. There are more chances of SAFETY than not if you wearing a seatbelt. sorry that I don't agree with you guys but if ukhwela kwe yam imoto think of THEBE xa esithi " fak' isafety belt wena, sek'qhuba mina manje"

I don't like wearing any either, but I can tell you now, I actually make an effort to waer it, my friend uBongiwe survived a horrible accident due to it, so now I definately do not feel stupid for wearing one!  Please wear it.  But I do understand your point of view and I don't want to scare you, but imagine this happening to you while you are arrested for not wearing any seatbelt:

Pretoria - A man, 52, cried in the Pretoria High Court while he told how inmates in a police cell raped him.

The man, a diabetic from Primrose, Germiston, is suing the Minister of Safety and Security and the Minister of Justice for R4.3m in damages.

He claims he was twice unlawfully arrested and that after the second arrest, he was raped in police cells.

He testified how he was arrested on February 28 at the magistrate's court in Witbank when he wanted to fetch a copy of his charge sheet.

Singing and dancing

According to him, he was kept in a cell along with 30 fellow prisoners in the holding cells at the Witbank police station.

He told how he was carried, naked, around the cell by four men while the rest sang and danced. The court had to be adjourned before the emotional man could continue testifying. "The singing and foot stamping became louder," he said.

He described how of the prisoners took one of the green mattresses in the cell, rolling it up lengthwise and put it in front of him. He was told to kneel down over the rolled up mattress.

"The intensity of the singing and dancing reached a climax".

The men started raping him. "I must have lost consciousness then. When I came to, they were still busy".

They later stopped and ignored him for the rest of the two days that he was kept locked up with them in the same cell.

He was taken to court where bail was set for R1 000.

But he could only call someone to bring him the money a day after his court appearance.

He also had to be taken to hospital as he had not been able to get his diabetic medicine while being in custody. The man said he asked the doctor to admit him because he was scared of going back to the cell. He did not tell the doctor or the police members what had happened to him.

A friend paid his bail, the case against him was dropped and the money paid back.

The case continues.
